Yoon faces accusations of conspiring with former Defense Minister Kim Yong-hyun and others to incite insurrection by declaring an unlawful state of emergency on December 3, despite a lack of wartime conditions or national crisis. He is also alleged to have sent troops to the National Assembly to prevent lawmakers from rejecting the martial law declaration and to have planned the arrest of key political figures.
According to Seok, Yoon asserted that he exercised his constitutional right to declare martial law to inform the public of the crisis posed by the main opposition party gaining control of the National Assembly. Yoon maintained that he lifted the martial law immediately after the Assembly voted against it and argued that his actions could not be characterized as insurrection due to the absence of violence or arrests of politicians.
Seok further stated that Yoon indicated he had not intended to prolong the martial law, mentioning he had not prepared any operational manuals for such a situation and expected a quick Assembly vote to dismiss it.
Yoon expressed concern for the state of the nation, particularly about citizens struggling in harsh conditions and young people potentially becoming disheartened by their circumstances. Additionally, he expressed worry over the health of his wife, who has been experiencing health issues while he remains detained.
The main opposition party criticized Yoon for focusing on national concerns while allegedly causing significant issues himself. A spokesperson stated that Yoon's actions undermined constitutional order and harmed the economy, accusing him of lacking accountability for his actions.
On the topic of his wife's health, the spokesperson remarked that public sentiment would not shift in Yoon's favor due to ongoing corruption allegations involving the couple, urging him to cease efforts to delay legal proceedings.

윤 대통령의 변호사인 석동현은 기자들에게 윤 대통령이 "모든 것이 헌법의 범위 안에서 이루어졌다"고 주장하며, 12월 3일 계엄령을 선포하는 것이 어떻게 반란 행위로 간주될 수 있는지에 대해 의문을 제기했다고 전했다.
석 변호사와 다른 변호사들은 윤 대통령이 구치소에 수감된 지 이틀 후에 서울 구치소에서 윤 대통령과 만났다.
그는 김용현 전 국방부 장관 등과 공모하여 전시 또는 국가적 위기 상황 없이 불법적이고 헌법에 어긋나는 비상사태를 선포해 반란을 선동한 혐의를 받고 있다.
또한, 윤 대통령은 국회의원들이 계엄령 선언을 투표로 무효화하는 것을 저지하기 위해 군을 국회에 파견하고, 주요 정치인들을 체포할 계획을 세운 것으로 알려졌다.
석 변호사에 따르면, 윤 대통령은 국회가 더불어민주당(DPK)이 장악한 상황에서 국민에게 국가가 직면한 위기를 알리기 위해 헌법상의 권리를 행사했다고 말했다.
윤 대통령은 또한 국회가 자신의 계엄령 선언을 무효화하자 즉시 계엄령을 해제했다고 강조했다.
그는 자신의 행동이 어떠한 유혈사태도 없었고 정치인의 체포도 없었기 때문에 반란 행위가 될 수 없다고 변호했다.
석 변호사는 윤 대통령이 계엄령을 장기간 유지할 의도가 없었으며, 그러한 상태에서 행정부와 사법부를 운영하는 매뉴얼도 준비하지 않았고, 국회가 신속하게 계엄령을 무효화할 것으로 충분히 예상했다고 전했다.
석 변호사는 윤 대통령이 구치소에서 설 연휴를 보내는 것에 대한 언급이나 현재 대통령으로서의 상황에 대한 특별한 이야기는 없었다고 전했다. "그러나 그의 표정에서 많은 생각이 오가고 있는 것을 알 수 있었다"고 덧붙였다.
석 변호사는 윤 대통령이 한국의 미래에 대한 우려를 표했다고 말했다.
"그는 많은 사람들이 이 추운 환경에서 생계를 위해 고군분투하고 있다는 것에 대해 걱정하고 있었다"고 석 변호사는 말했다. "또한, 젊은이들이 큰 꿈을 꾸어야 할 시기에 현실에 실망하고 낙담할 수 있다는 점에 대해 염려했다."
석 변호사는 김건희 여사가 최근 건강 문제를 겪고 있다고 밝혔다. 윤 대통령은 1월 15일 구치소에 수감된 이후 아내를 만나지 못한 상태에서 김 여사의 건강 상태에 대해 걱정하고 있다고 전했다.
더불어민주당은 윤 대통령이 국가의 상황에 대해 걱정하는 것은 말이 안 된다며 비판했다.
"그는 반란을 선동하고 우리의 헌법 질서를 흔들었다. 또한 우리의 경제를 파괴했다"며 DPK의 수석 대변인 조승래가 말했다. "그가 국가의 미래를 걱정한다는 말은 매우 오만하다."
"국가를 걱정하는 사람이 어떻게 군대를 배치하여 반란을 시작하고 지지자들을 선동할 수 있겠냐"며 조 대변인은 말했다. "그는 법적 판단 앞에서도 자신의 잘못을 인정하지 않고 있다. 그의 부끄러움에는 끝이 없어 보인다."
김 여사의 건강 문제에 대해 조 대변인은 윤 대통령이 "사람들의 동정을 얻으려는 시도를 잊어야 한다"고 언급했다.
"사람들은 김과 윤을 온갖 부패 혐의로 오염된 부부로만 기억할 것이다"라고 대변인은 말했다. "윤 대통령이 나라를 걱정하고 있다면, 법적 절차를 지연시키려는 시도를 중단해야 한다."
