The prosecution has sought a panel of outside experts to determine whether to appeal the recent acquittal of Samsung Electronics Co. Chairman Lee Jae-yong regarding a 2015 merger case, judiciary sources reported on Thursday.
On Monday, the Seoul High Court upheld Lee's acquittal on charges of accounting fraud and other irregularities linked to the controversial merger between Cheil Industries Inc. and Samsung C&T Corp.
The appellate court confirmed the not-guilty verdict for Lee, who faced allegations of stock price manipulation and accounting fraud during the merger. Prosecutors suspect this was intended to facilitate control over South Korea's largest conglomerate at a reduced cost.
An investigative team from the Seoul Central District Prosecutors Office has requested a review by an independent investigation review committee to assess the possibility of taking the case to the Supreme Court.
The panel, which consists of five or more experts, is scheduled to hold a closed-door meeting on Friday to evaluate the matter.
Following the panel's decision, the prosecution is expected to make a determination on whether to appeal by Monday.
The prosecution is required to seek such deliberation if all allegations against a defendant result in not-guilty rulings in lower courts. While the prosecution is advised to respect the panel's decision, it is not obligated to comply.

서울중앙지방검찰청의 수사팀은 이 사건을 대법원에 상고할지 여부에 대한 독립적인 조사 위원회의 검토를 요청했다고 소식통은 밝혔다.
이 패널은 다섯 명 이상의 전문가로 구성되며 금요일에 비공식 회의를 열어 의제를 논의할 예정이다.
패널의 결정을 받은 검찰은 월요일까지 항소 여부를 결정할 것으로 예상된다.
검찰은 피고인에 대한 모든 혐의가 하급 법원에서 무죄로 판결되면 이러한 심의를 요청해야 한다. 패널의 결정을 존중할 것이 권장되지만 반드시 따를 필요는 없다.
